ABILITY.FORUM · AI HIRING CHECK

Using AI to hire? Make sure it's legal.

Take a free 60-second check and see where you stand on new AI hiring disclosure laws.

Operational compliance support from a recruiting team. Not legal advice.

THE 60-SECOND CHECK

Three questions. One clear answer.

1. Do you use software that screens, ranks or scores job applicants?
2. Do you hire anyone who lives or works in Illinois or Colorado?
3. Do you currently tell applicants when AI is used in hiring?

THE LAWS WE TRACK

What's changing for employers

Illinois HB 3773

In effect since January 1, 2026. Employers can't use AI in ways that discriminate in hiring, promotion or other employment decisions, and must tell applicants and employees when AI is used. It covers employers with at least one Illinois employee. The state's detailed notice rules are still pending, so we build interim notices based on the law itself.

Colorado SB 26-189

Takes effect January 1, 2027. It replaced the original Colorado AI Act with disclosure and consumer-rights duties when automated tools influence decisions like hiring. State rules are being finalized and a federal court has paused enforcement during a lawsuit, but the start date hasn't changed.

Frameworks we align with

The NIST AI Risk Management Framework, with ISO/IEC 42001 as a reference. We align with these standards. We don't certify compliance.
